WHEN A CHILD IS ABANDONED

When couples marry and one spouse is already a parent, the other spouse often wants to adopt the child. If the other birth parent is not deceased, that parent must voluntarily agree to the fostering, with the sole exception of abandonment situations. If the other birth parent has abandoned a child for over a year, has had no contact with the child, and has not paid child support during that time, that birth parent’s consent to the adoption is not required. An adoption by a stepparent ends the parental rights of that birth parent while simultaneously granting all parental legal rights and responsibilities to the stepparent.
